Respond to the post and explain how Utilitarianism works differently than Ethical Egoism and if Ethical Egoism would result in a different conclusion if the administrative agency (DBPR)  is acting ethical or not in revoking the business license and liquor license under these facts.

The ethical theory I selected is Aristotle’s Doctrine of the Mean. According to this theory, virtue lies between two vices, with extremes representing vice. Aristotle argued that any "extreme" is a vice, and virtue is found in the balance between excess and deficiency. Essentially, we should strive to be virtuous by doing the right thing toward the right people in the right way. In Aristotle’s
_Nicomachean Ethics_, Aristotle emphasized that there are no universal laws that apply to all situations, and we must approach each case individually. In the specific case of the DBPR revoking the business’s liquor license due to drag performances, the business could argue that the DBPR’s actions are excessive and an extreme response. From Aristotle’s perspective, the DBPR’s decision can be seen as restrictive and falls into the category of excess. Thus, under Aristotle’s Doctrine of the Mean, the DBPR’s decision seems unethical, as it represents an extreme and disproportionate punishment. Aristotle would likely advocate for a more balanced approach that respects the rights of the business while also considering the values of both the political leaders and the community.

Respond to the post and explain how Utilitarianism works differently than Ethical Egoism and if Ethical Egoism would result in a different conclusion if the administrative agency (DBPR)  is acting ethical or not in revoking the business license and liquor license under these facts.

Utilitarianism is an ethical theory that evaluates actions based on their consequences, emphasizing the greatest good for the greatest number (Mill, 1863). According to utilitarianism, an action is considered ethical if it maximizes overall happiness and minimizes harm. Act utilitarianism assesses each action’s direct impact, while rule utilitarianism considers whether the action aligns with rules that generally promote overall well-being. Applying utilitarianism to DBPR’s decision requires weighing the potential benefits and harms of revoking the business’s licenses.

From DBPR’s perspective, the agency may argue that its actions serve the public interest by enforcing laws that maintain “decency” in entertainment, particularly in venues accessible to minors. By shutting down the business, DBPR might claim that it is upholding moral standards and responding to community concerns. Additionally, the state may justify the action as part of broader efforts to regulate businesses and ensure compliance with laws governing public performances. However, these potential benefits must be weighed against the extensive harm caused by DBPR’s actions.

The revocation of the business’s licenses results in immediate economic harm, including job losses for employees and financial strain on the business owners. Additionally, this action sets a dangerous precedent for censorship of unpopular or minority expressions, creating a chilling effect on free speech. It disproportionately impacts LGBTQ+ communities, reinforcing social discrimination and marginalization. The enforcement also imposes legal costs on both the business and taxpayers, as Florida will likely face prolonged litigation, given that similar laws have already been struck down in federal court. Since DBPR’s action does not provide significant societal benefits and instead results in economic, social, and legal harm, the decision fails the utilitarian test. The negative consequences outweigh any perceived benefits, making DBPR’s actions unethical from a utilitarian perspective.

Thus, applying utilitarianism, in my opinion, DBPR’s enforcement is morally unjustified, as it causes more harm than good. The revocation of business licenses suppresses free expression, undermines economic stability, and disproportionately harms marginalized communities without a compelling public benefit. The principle of maximizing happiness and minimizing harm suggests that allowing the business to operate freely would result in a greater overall benefit to society.

**Module 2 Activity 3: Cruel and Unusual?**

    **Research**

Go back to the cruel and unusual definition wiki that you completed with your classmates.  Look through the definitions and find the one with the most "same" comments that resonates most with your own perspective.  This might be the definition that you wrote and it might not be!

    **Written Discussion**

Begin your discussion by identifying the definition that you will be applying to the hypothetical situation.  Then, read the hypothetical below and answer the questions.

    _Hypothetical_

Christopher, a high school junior who was almost 18 (a legal adult) told two of his friends, aged 15 and 16, that he wanted to murder someone. He had a plan. Christopher would break into Shirley’s home, tie her up, and throw her off a bridge. His two friends weren’t sure, but they decided to help Christopher when he told them they could “get away with it” because they were minors. The three boys met at 2:00 a.m. on the night of the murder, but Christopher’s 16-year-old friend was nervous and backed out. Christopher and his 15-year-old friend went to commit the crime they’d planned. The pair entered Shirley’s home through an open window, waking her up. While she turned on a hallway light and asked “Who’s there?” Christopher went down the hall and entered Shirley’s bedroom. He recognized her from a car accident the two had been in, which he later admitted supported his decision to kill. The boys tied Shirley’s hands, covered her eyes, and drove her to a nearby bridge. They threw her into the river, where she drowned. Christopher was overheard bragging about the murder the next day at school where police arrested him. He waived [refused] his rights to remain silent and to have an attorney present. Christopher then admitted to the murder and agreed to reenact the crime on videotape. His first-degree murder trial occurred nine months later after he had turned 18. After hearing about the plan, Christopher’s bragging, and watching the videotaped reenactment, the jury quickly convicted him and recommended the death penalty. The judge agreed, and Christopher was sentenced to death.

    _Questions_

    1. What arguments would convince you that the punishment in this situation IS NOT cruel and unusual?

    2. What arguments would convince you that the punishment in this situation IS cruel and unusual?

    3. Using the definition you chose, how would you rule in this case?  Make sure to clearly identify how you used the definition to come to your decision.

    4. Is there anything about the details of this case that, if different, would change your ruling? Explain.

Domestic violence investigations often require nuanced approaches, particularly in the absence of clear physical evidence. Discuss a range of investigative techniques an investigator might employ to substantiate a domestic violence case. How can behavioral analysis, witness statements, forensic evidence, and digital footprints be integrated into the investigation? Examine how investigators can address barriers to victim cooperation or instances of conflicting testimony, emphasizing trauma-informed practices and legal frameworks. Provide examples of cases or scenarios where these techniques were effectively utilized.

    **Investigative Techniques**

Domestic violence investigation can be complex primarily because of the limited physical evidence presented. Witnesses’ statements, forensic evidence, behavioral analysis, and digital footprints are investigative techniques that are deployed in domestic violence cases. Investigators can analyze a suspect's behavior and the victim involved in a case. Behavioral analysis allows investigators to monitor distress-related emotional patterns and responses (Catlin et al., 2023). For instance, an investigator might observe a victim display anxiety and nervous traits when asked to explain the order of events. The observations assist the investigators in suggesting the possible involvement of a suspect in a domestic violence claim. The digital footprint approach examines technological communication, such as text messages, online activities, and transactions (Catlin et al., 2023). Digital footprints help in the revealing of social media patterns and timelines that are crucial during the investigation. For instance, law enforcers may investigate the digital patterns of a suspect to determine if there might be any threats made across different social media platforms of a victim.

The statements investigators gather from witnesses lead to essential information about what happened during the incident. The investigation receives external validation about emotional stress during arguments from witness statements (Catlin et al., 2023). The residents, alongside members of the household, must describe everything they experienced and observed when neighbors fight in the neighborhood. The forensic investigation of domestic violence requires both biological evidence collection of fingerprints and DNA samples. The evidence collected by investigators provides physical elements that support the claim of the attacker's participation, according to Catlin et al. (2023). In a domestic violence case involving sexual assault, there are significant DNA samples taken from the victim's sexual evidence that become vital proof to identify the suspect.

    **Integration of Techniques**

Behavioral science research enables police officers to determine the essentials of their interrogation approach (Catlin et al., 2023). The research findings about victims' emotional distress behaviors allow investigators to develop specific questions for information collection during an investigation. Such knowledge lets police officers become aware of the delicate nature of events under investigation. Scientists use Forensic evidence to obtain physical proof that directly opposes what victims say during questioning (Catlin et al., 2023). Case evidence becomes stronger through the investigative process, which verifies statements by using concrete physical information. DNA evidence combined with fingerprints found at crime locations serves as forensic proof to connect suspects with their actions when they deny victim testimonies. The reconstruction of accurate timelines happens through digital footprints because these records offer contextual evidence that supports statements from incident victims (Catlin et al., 2023). Suspicious individuals who declare their location during a specific criminal period can trigger investigators to pursue additional facts about their movements.

    **Addressing Barriers to Cooperation**

Law enforcers should approach victims with understanding to recognize the impact of trauma (Huecker et al., 2023). This may include creating a comfortable environment that does not trigger them. Therefore, the victims can express themselves without any rush or pressure. Familiarity with the law regarding domestic violence, such as protective laws, inspires victims to share their tragic experiences (Huecker et al., 2023). Besides offering them knowledge of what the law can do for them, the available resources can encourage cooperation.

**Example of Effective Use of Techniques**

In a scenario where a victim feels unsafe to report abuse, investigators can utilize digital footprints by analyzing their social media interactions. They can identify any threats posed to the victim, combined with witness statements about the behavior change. The technique will assist in establishing strong cases against the suspect. In another case when neighbors report frequent arguments and loud bangs with their residents, and the victim was appearing hurt and in distress. Witness statements from the neighbors can provide the investigators with sufficient information to allow an intervention if they suspect abuse in the home.
